Preambule

World Watch Day / La journée internationale d'horlogerie is a not-for-profit organisation whose aim is to
promote the creations, heritage and culture of watchmaking and make it known to the general public and watch
enthusiasts. To this end, it organises a series of events throughout the world on 10th October each year.
The World Watch Day Association (Hereafter the WWD Association) intends to open up and encourage
events to as many people as possible, so that the day can have as wide an impact as possible. Individuals,
companies and organisations will be free to organise events to make the day a real celebration of watchmaking.
At the same time, the WWD Association will be proposing an Official Programme and is encouraging the
participation of third-party contributors to this Official Programme.
It is therefore opening a call for applications so that anyone can submit their contribution project (hereinafter
Contribution) for prior approval by the WWD Association in order to benefit from the actions and communication
relays that the WWD Association will implement to publicise this initiative as widely as possible. Among the
advantages, Approved Contributors will be abe to publicise their Contribution using the WWD logo shown in the
Appendix (hereinafter the Contributors).

ARTICLE 1. Submission of Contributions

a. Applications are open to any individual, company or institution wishing to submit a Contribution to the official WWD programme.

Candidates are invited to submit their application to the WWD Association by applying directly using the form on the worldwatchday.org website.

They should provide all relevant information, in particular on

  • the nature of their Contribution (event, exhibition, demonstration)
  • the purpose of the Contribution
  • the location of the Contribution (geographical, real or virtual)

b. The application and the entry of detailed information on the events must be submitted via the corresponding web platform within the registration deadline communicated on the website. No contribution will be accepted or considered once the deadline has passed.

ARTICLE 2. Imperative conditions for acceptance of the Contribution

In order to receive the approval of the WWD Association and to have his/her Contribution included in the official programme of the World Watch Day, the Contributor must comply with the conditions below:

a. The Contribution contributes to the objective of the World Watch Day, i.e. to celebrate and promote watchmaking culture, in particular heritage and know-how.
The Contribution is not of a commercial nature and is not used solely for advertising purposes.

b. The Contribution is open to the public, with free admission for visitors wherever possible. Any admission
charge is limited to covering the costs incurred.

c. The Contribution will not be used for political or religious purposes.

d. The content and framework of the Contribution are free from discriminatory statements.

ARTICLE 3. Discretionary approval

The WWD Association reserves the discretionary right to approve or reject a Contribution for inclusion in the Official Programme. The WWD Association's objective will be to ensure consistency and a high standard in the implementation of the Official Programme, which may justify it rejecting an application notwithstanding compliance with the criteria set out in article 2. It will take care to ensure that the Contributions proposed and accepted are of equal or equivalent quality.

ARTICLE 4: Non-Approved Candidates

Candidates whose projects have not been approved by the WWD Association shall be free to take up their project on their own account outside the Official Programme, taking care not to present themselves as an Approved Contributor as defined below. The WWD Association undertakes not to take over all or part of a non-approved contribution.

ARTICLE 5. Participation in the Official World Watch Day Programme

a. The WWD Association will provide the Approved Contributor with a logo and visual identity elements (Visual Identity) enabling them to display their participation in the official programme.

b. The Approved Contributor undertakes to use the Visual Identity and to comply with the graphic charter as set out in the Appendix without making any modification, cutting or cropping.

c. The Approved Contributor undertakes to ensure that all or part of the Visual Identity is clearly linked to its Approved Contribution dedicated to Word Watch Day and will take all precautions to avoid creating any confusion with its commercial activity.

d. The Agreed Contributor shall not juxtapose its trademark with all or 

ARTICLE 6. Visibility of World Watch Day and Approved Contributions

a. b. The WWD Association reserves the right to propose its own events as part of the Official Programme. It undertakes to publicise the Approved Contributions through appropriate communication measures.

c. The Approved Contributor is encouraged to submit communication content to the WWD Association so that the latter may - at its sole discretion - integrate it into its official communication channels.

d. The Approved Contributor accepts that the WWD Association may film or photograph all or part of their event or demonstration with a view to disseminating them on its own communication media, whatever they may be and without territorial limits.

e. The Approved Contributor undertakes to incorporate the elements of the official programme (and in particular the use of the WWD logo) on all media in the promotion of its Approved Contribution.

ARTICLE 7. Intellectual Property

a. Each Party shall retain the intellectual property of its content and undertakes to respect the limits of the authorisation granted by the other Party to use its intellectual property.

b. The Approved Contributor grants WWD Association the following intellectual property rights in its Approved Contribution;

The right of reproduction : The right to fix, digitize, reproduce, directly or through any service provider of its choice, all or part of the Approved Contributions, in black and white and/or in color, in all formats, colors, and materials, and in unlimited quantities, using any technical process known or unknown to date, on the all media the right of representation: The right to exhibit, broadcast, communicate, or otherwise make accessible to the public, directly or indirectly, all or part of the Contributions, in black and white and/or in color, in all formats, colors, and materials, in unlimited quantities, and using any framing methods, through any technical process, such as public or private projection, sound and/or image telecommunications via analog or digital means, by terrestrial transmission, cable, or satellite, through any private or public telecommunications network and any means of data transmission, digitized or not, through all dissemination methods and techniques, regardless of their formats and modes of visualization (fixed or mobile, individual or collective);

The right of adaptation – The right to modify or crop Approved Contributions but only as may be strictly necessary to conform with imposed formats

The rights are granted worldwide and for the duration of the World Watch Day (including any communication within the 3 months preceding or following the 10th October).

c. The Visual Identity and the Approved Contribution shall be used by the respective Parties during a period limited to the month preceding and following the World Watch Day event on 10th October. After this date, only retrospective use shall be authorised.

d. For all intents and purposes, it is specified that the WWD Association shall refrain from reproducing all or part of a Non-Approved Contribution that has been submitted in the context of the call for applications.

ARTICLE 8. Third Party Rights

The Approved Contributor guarantees that its Approved Contributions and communication content submitted to the WWD Association will respect any third party rights and in particular:

  • Personal image rights;
  • All intellectual property rights on any creations or performances.

ARTICLE 9. Financing

a. The Approved Contributor shall bear all the costs associated with the organisation and running of its Contribution.

b. As far as possible, he/she will ensure that the public has free access to the Event.

c. If access is subject to a charge, the sum will be intended solely to cover part of the costs incurred

ARTICLE 10. Cancellation

a. In the event of cancellation of the event organised by the Approved Contributor, the latter undertakes to inform the WWD Association as soon as possible so that the Contribution can be withdrawn from all advertising media. The Authorised Contributor undertakes to assume all the consequences vis-à-vis the public resulting from the non-removal of an event from the advertising media.

b. In the event that the WWD Association is itself forced to cancel the Event, for whatever reason (force majeure, act of God, epidemic, natural disaster, etc.), it will inform the Approved Contributor as soon as possible. The latter will remain free to continue the event under their own name but undertakes to remove the WWD Association's Visual Identity (and in particular the logo).

ARTICLE 11. Exclusion

a. The WWD Association is entitled to exclude at any time from participation in WWD any Approved Contributor who violates one of the conditions of the Charter.

b. The WWD Association shall notify the Approved Contributor of the nature of the violation by email or any other means of written communication. If the said violation is not remedied within 24 hours, the Approved Contributor will automatically be excluded from the official World Watch Day
programme.

c. Exclusion entails the immediate cessation of all actions and communication relays by the World Watch Day association in connection with the activities or events of the Approved Contributor.

d. From the moment of exclusion, the Approved Contributor is prohibited from using the communication material made available or from referring to World Watch Day in any form whatsoever.

ARTICLE 12. Disputes

In the event of a dispute, the Parties undertake to seek an amicable solution within 15 days of written notification of the complaint by the complaining Party. If the Parties fail to reach an amicable agreement within 15 days, any dispute concerning the interpretation and/or performance of the General Terms and Conditions of Participation will be governed by Swiss law and will fall within the jurisdiction of the Courts of the Canton of Geneva.

ARTICLE 13. Final provisions

Acceptance of the general conditions of participation by the World Watch Day Authorised Contributor constitutes a contract. In addition, all elements of registration for the event are considered to be an integral part of the contract. Approved by the WWD Association Committee
